Withdrawal Policy

1. Right of Withdrawal

If you are a consumer, you have the right to withdraw from this contract within fourteen (14) days without giving any reason.

The withdrawal period is fourteen (14) days from the day on which the contract is concluded.

To exercise your right of withdrawal, you must inform us of your decision to withdraw from the contract by means of a clear and unambiguous statement.

You may inform us, for example, by email or by letter.

You may use the Model Withdrawal Form provided below, but its use is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send your notification concerning the exercise of your right of withdrawal before the withdrawal period has expired.

2. Effects of Withdrawal

If you withdraw from this contract, we will reimburse all payments received from you in connection with the withdrawn contract without undue delay and no later than fourteen (14) days from the day on which we receive notification of your withdrawal.

Unless expressly agreed otherwise, the reimbursement will generally be made using the same payment method that you used for the original transaction.

You will not incur any additional fees as a result of the reimbursement from our side.

3. Immediate Start of the Service

Zelia provides digital services that may become available immediately after the subscription or purchase has been completed.

If you expressly request that the provision of the service begins before the end of the fourteen-day withdrawal period, we may begin providing the service immediately.

Before the service begins, you may therefore be asked to confirm the following:

“I expressly request that Zelia begins providing the service before the expiry of the 14-day withdrawal period.”

Requesting the immediate start of the service does not automatically remove your statutory right of withdrawal.

4. Withdrawal After the Service Has Already Started

If you expressly requested that the service begins during the withdrawal period and subsequently exercise your right of withdrawal, you may be required to pay an appropriate amount for the services already provided up to the time when you informed us of your withdrawal.

The amount will be calculated proportionally based on the total contractual price and the portion of the service that has already been provided.

Where the statutory requirements for such compensation are not fulfilled, no compensation will be charged.

5. Expiry of the Right of Withdrawal

For services, the right of withdrawal may expire before the end of the fourteen-day withdrawal period if the service has been fully performed.

This requires, in particular, that:

1. you have expressly agreed that Zelia may begin performing the service before the expiry of the withdrawal period;

1. you have confirmed your knowledge that your right of withdrawal will expire once the service has been fully performed; and

1. Zelia has fully performed the agreed service.

For subscriptions and other ongoing services, the mere activation of the subscription or granting of access does not by itself necessarily constitute full performance of the entire contract.

6. Digital Content

Where Zelia separately provides digital content that is not supplied on a physical medium and for which the statutory rules concerning digital content apply, the right of withdrawal may expire once performance has begun if the applicable legal requirements have been fulfilled.

This generally requires that you:

1. expressly consent to the beginning of performance before the expiry of the withdrawal period;

1. confirm that you are aware that you lose your right of withdrawal by giving such consent; and

1. receive the legally required confirmation of the contract and your consent.

Where these requirements are not fulfilled, the statutory right of withdrawal remains unaffected.

7. Subscriptions

The statutory right of withdrawal applies independently of the contractual cancellation options relating to a Zelia subscription.

Withdrawal and cancellation are legally different.

Withdrawal concerns the reversal of a recently concluded contract within the statutory withdrawal period.

Cancellation concerns the termination or non-renewal of an existing subscription in accordance with the applicable subscription terms.

Cancelling the automatic renewal of a subscription does not automatically constitute a withdrawal from the original contract.

Likewise, exercising the statutory right of withdrawal is not the same as merely disabling automatic renewal.

8. Refunds

If a valid withdrawal is exercised, any refund due will be processed in accordance with the applicable statutory requirements.

Where you requested that the service begin immediately and Zelia is legally entitled to compensation for services already provided, this amount may be deducted from the refund.

Any amount exceeding the legally permissible compensation will be refunded.

10. Electronic Withdrawal Function

Where required by applicable law, contracts concluded through Zelia's online interface may also be withdrawn using the electronic withdrawal function provided on the website.

The electronic withdrawal function does not restrict your right to exercise your withdrawal by another legally permitted method, such as email or letter.

After submitting an electronic withdrawal declaration, you will receive confirmation of its receipt in accordance with the applicable legal requirements.
