This Liability Disclaimer & Copyright Notice applies to the Zelia website, the Zelia Discord bot, its dashboard, related services, documentation and other content provided as part of Zelia.
1. General Information
The information and services provided by Zelia are created and maintained with reasonable care. However, we do not guarantee that all information made available through our website, Discord bot, dashboard or other services is always complete, accurate, current or suitable for a particular purpose.
Zelia is continuously developed and may receive updates, modifications, maintenance work or technical changes at any time. Features may therefore be changed, temporarily unavailable or discontinued where reasonably necessary.
Nothing in this Disclaimer excludes or limits liability where such exclusion or limitation would be prohibited by applicable law.
2. Availability of the Service
We aim to keep Zelia and its associated services available and operational. However, uninterrupted or error-free availability cannot be guaranteed.
Temporary interruptions may occur, including but not limited to:
- maintenance and software updates;
- technical failures;
- server or network outages;
- security incidents;
- changes to third-party services or APIs;
- outages or restrictions affecting Discord or other external providers;
- circumstances outside our reasonable control.
Unless expressly agreed otherwise, no specific level of continuous availability, uptime or uninterrupted access is guaranteed.
We reserve the right to temporarily restrict access to individual features or the entire service where reasonably necessary for maintenance, security, legal compliance or technical reasons.
3. Limitation of Liability
Zelia shall be liable without limitation where liability is mandatory under applicable law, including in cases of:
- intentional misconduct or gross negligence;
- injury to life, body or health;
- liability under mandatory statutory product liability provisions;
- expressly assumed guarantees; or
- any other case in which liability cannot legally be excluded or restricted.
In cases of slight negligence, Zelia shall only be liable where an essential contractual obligation has been breached. Essential contractual obligations are obligations whose proper fulfilment is necessary for the performance of the agreement and on whose fulfilment the user may reasonably rely.
In such cases, liability shall be limited to the damage that was reasonably foreseeable and typical for the relevant type of agreement at the time the agreement was concluded.
To the extent permitted by law, Zelia shall not be liable for indirect or consequential losses resulting solely from circumstances outside our reasonable control.
The above limitations also apply to our representatives, employees, contributors and other persons acting on our behalf where legally permissible.
4. User Configuration and Data
Certain features of Zelia may allow users to configure the bot, provide information, create content, manage settings or otherwise interact with servers, channels, roles and other Discord-related resources.
Users are responsible for reviewing their own configurations and ensuring that they grant Zelia only the permissions that are necessary for the functions they intend to use.
Users should maintain appropriate backups of important information where technically possible and should not rely on Zelia as the sole storage location for information whose loss could cause significant damage.
We are not responsible for damage resulting solely from incorrect configuration, unauthorised permissions granted by a user, incompatible third-party modifications or actions initiated by an authorised user, except where such damage was caused by conduct for which we are legally responsible.
5. Third-Party Services
Zelia depends on or may interact with third-party platforms, software, APIs, hosting infrastructure and other external services.
The availability and functionality of these third-party services are outside our direct control.
Changes, restrictions, outages or termination of third-party services may affect individual Zelia features or, in some cases, the availability of Zelia as a whole.
We are not responsible for the independent operation, content, security practices or availability of third-party services, except to the extent that responsibility cannot legally be excluded.
The use of third-party services may additionally be subject to the respective provider's own terms, policies and privacy practices.
6. External Links
Our website or services may contain links to websites or resources operated by third parties.
We do not control the content of external websites and do not automatically adopt third-party content as our own merely by providing a link.
Responsibility for the content and operation of an external website remains with its respective operator.
External links are reviewed where reasonably appropriate at the time they are added. Continuous monitoring of external websites without a specific indication of unlawful content is generally not practicable.
If we become aware that a linked website contains unlawful content or that continued linking would otherwise violate applicable law, we will review the matter and remove or disable the relevant link where legally required and reasonably possible.

Where Zelia allows users to submit, store, transmit or otherwise provide content, the respective user remains responsible for the content they provide and for ensuring that they possess all rights and permissions necessary to use that content.
Zelia does not automatically endorse or adopt user-generated content as its own.
Where the applicable requirements for intermediary services are met, responsibility for information stored at the request of users is determined in accordance with the applicable provisions of the Digital Services Act and German law.
If we obtain sufficient knowledge of unlawful content, we may investigate the matter and remove, disable or restrict access to the relevant content where required or permitted by law.
Users may report potentially unlawful content through the contact options provided on our website.

Information provided through Zelia, its website, documentation, automated responses or other features is intended for general informational and functional purposes only.
Unless explicitly stated otherwise, Zelia does not provide legal, financial, medical, tax or other regulated professional advice.

Unless otherwise stated, original content made available through Zelia, including but not limited to:
- website texts;
- graphics;
- logos;
- branding elements;
- interface designs;

- software-related content;
- original media; and
- other creative material
is protected by applicable copyright and intellectual property laws.
Copyright protection exists independently of whether a copyright symbol or copyright notice is displayed.
The reproduction, distribution, modification, publication, commercial exploitation or other use of protected Zelia content beyond what is permitted by applicable law requires prior permission from the respective rights holder.

The Zelia name, logo, visual identity and other original branding elements may not be used in a manner that falsely suggests sponsorship, partnership, endorsement or official association with Zelia.
You may refer to Zelia by name where reasonably necessary, for example when describing or discussing the service, provided that such use does not infringe applicable intellectual property rights or misleadingly imply an official relationship.
12. Third-Party Copyright and Trademarks
Zelia may display or reference names, trademarks, logos, software, services or other materials belonging to third parties.
All third-party trademarks, service marks, logos and copyrighted materials remain the property of their respective owners.
Their appearance within or in connection with Zelia does not imply ownership, sponsorship, endorsement or affiliation unless this is expressly stated.
We endeavour to respect the intellectual property rights of third parties.
13. Copyright Infringement
If you believe that content available through Zelia infringes your copyright or other intellectual property rights, please contact us and provide sufficient information to allow us to review the matter.
A report should preferably include:

This Disclaimer and Copyright Notice is governed by the laws of the Federal Republic of Germany, subject to mandatory provisions of applicable consumer protection and international private law.
Mandatory rights available to consumers under the laws of their country of habitual residence remain unaffected where applicable.
