These Terms of Service (“Terms”) govern access to and use of Zelia, a Discord application and bot (“Zelia”, the “Bot”, the “Service”, “we”, “us”, or “our”).
Please read these Terms carefully before using Zelia.
By inviting Zelia to a Discord server, authorizing Zelia, using a Zelia command or feature after being given reasonable access to these Terms, or otherwise using the Service, you agree to these Terms.
If you do not agree to these Terms, you must not use Zelia.

2. Scope of these Terms
These Terms apply to all users of Zelia, including:
- Discord server owners;
- server administrators and moderators;
- users interacting with Zelia through commands, buttons, menus, forms, tickets or other features;
- persons authorizing or installing Zelia;
- users of any web dashboard or other interface connected to Zelia.
Certain features may be subject to additional conditions. If additional conditions apply, they will be presented before the relevant feature is used or purchased.
Mandatory rights granted to consumers by applicable law remain unaffected.
3. Relationship with Discord
Zelia is an independent third-party application built for use with Discord.
Zelia is not operated, endorsed, sponsored or controlled by Discord Inc. unless expressly stated otherwise.
Discord and its trademarks, services and platform remain subject to Discord's own terms, policies and rules.
When using Zelia, you must also comply with all applicable Discord rules, including Discord's:
- Terms of Service;
- Community Guidelines;
- applicable safety requirements;
- platform rules; and
- other policies applicable to your use of Discord.
If these Terms conflict with mandatory requirements imposed by Discord on applications using its platform, the applicable Discord requirements take precedence regarding use of Discord's platform.
4. Age Requirements
You may only use Zelia if you meet the minimum age required to use Discord in the country where you live.
You must also comply with any additional age requirements imposed by Discord for particular servers, channels, commands, content or features.
If you have not reached the age of legal majority in your country, your parent or legal guardian must approve your use of Zelia where such approval is required by applicable law.
Zelia must not be used to circumvent Discord's age restrictions or age-verification systems.
5. Authorization to Add Zelia to a Server
You may only invite, install, authorize or configure Zelia for a Discord server if you have the necessary permission to do so.
By adding or configuring Zelia for a server, you confirm that:
- you are authorized to act for that server to the extent necessary for the requested configuration;
- you understand which Discord permissions are granted to Zelia; and
- you will not intentionally grant Zelia permissions for unlawful or abusive purposes.
Server owners and administrators remain responsible for deciding which permissions, roles, channels and features are made available to Zelia.
6. Description of the Service
Zelia may provide functions including, but not limited to:
- server administration;
- moderation tools;
- ticket and support systems;
- automation;
- user and staff management;
- server utilities;
- ratings or feedback systems;
- role and permission related features;
- emoji, sticker or similar server asset management;
- notifications;
- logging;
- statistics;
- commands and interactive features;
- integrations with Discord or third-party services.
The exact functionality available may change over time.
Some features may be experimental, beta features, temporarily unavailable or limited to certain servers or users.
The description of a feature provided within Zelia or on an official Zelia website forms part of the relevant service description where required by applicable law.
7. Acceptable Use
You may only use Zelia for lawful purposes.
You must not use or attempt to use Zelia to:
- violate applicable laws or regulations;
- violate Discord's Terms of Service, Community Guidelines or other applicable Discord rules;
- harass, threaten, stalk, intimidate or unlawfully discriminate against another person;
- distribute, promote or facilitate unlawful content;
- distribute malware, malicious scripts, phishing content or other harmful software;
- obtain passwords, authentication tokens, credentials or other confidential information without authorization;
- gain unauthorized access to accounts, servers, systems, databases or networks;
- exploit vulnerabilities, bugs or security weaknesses;
- circumvent technical restrictions, access controls, rate limits, bans, suspensions or security measures;
- intentionally overload, disrupt, damage or interfere with Zelia, Discord or connected infrastructure;
- impersonate another person, organization, administrator or member of the Zelia team in a misleading manner;
- conduct scams, fraud or deceptive activities;
- use Zelia for spam, unsolicited mass messaging or other abusive automated activity;
- unlawfully collect, publish, disclose or process personal information about other people;
- infringe copyright, trademark, privacy, publicity or other rights belonging to another person;
- facilitate illegal transactions or other unlawful activities;
- manipulate ratings, reviews, moderation records or similar systems through deception, automated abuse or coordinated misuse;
- knowingly submit false reports intended to harm another user;
- reverse engineer, copy or attempt to derive protected parts of Zelia except where such activity is expressly permitted by applicable law;
- resell, sublicense or commercially exploit access to Zelia without our prior permission, unless such activity is expressly permitted by us;
- use Zelia in a way that could reasonably endanger the security or integrity of another Discord server or user.
We may take proportionate action against misuse in accordance with these Terms and applicable law.
8. Emojis, Stickers and Other Third-Party Content
Features that allow users to import, copy, reproduce, manage or transfer emojis, stickers, images or other content do not give users ownership of that content or permission from the original rights holder.
You are responsible for ensuring that you have the necessary rights, licenses or permissions to use content submitted to or processed through Zelia.
You must not use Zelia to copy, reproduce or distribute copyrighted or otherwise protected material unlawfully.
The availability of a technical feature does not mean that every possible use of that feature is lawful.
9. Server Administration and Moderation
Zelia may provide tools that assist server owners, administrators and moderators.
Decisions made by server administrators using those tools remain the responsibility of the relevant server administrators unless the decision was made independently by Zelia.
For example, server administrators may configure Zelia to:
- assign or remove roles;
- restrict users;
- create or close tickets;
- record moderation actions;
- collect feedback;
- send notifications;
- manage server content.
Zelia does not automatically endorse or approve decisions made by administrators simply because its technical tools were used.
Administrators must use moderation and administration features lawfully and in accordance with Discord's rules.
10. User Content
“User Content” means information or material that users submit to, create through, or request Zelia to process.
You retain any rights you already have in your User Content.
Where necessary to provide the Service, you grant us a non-exclusive, limited, royalty-free right to process, store, reproduce, transmit or display User Content solely to the extent reasonably required to:
- provide the requested Zelia functionality;
- maintain the Service;
- prevent abuse or security incidents;
- comply with applicable legal obligations.
This permission does not transfer ownership of your User Content to us.
The permission ends when the relevant processing is no longer necessary, subject to applicable legal retention requirements and the provisions of our Privacy Policy.
You confirm that you have the necessary rights to provide User Content to Zelia.
11. Removal and Restriction of Content
Where Zelia stores or processes User Content, we may restrict or remove content where reasonably necessary because:
- the content is unlawful;
- the content violates these Terms;
- the content infringes third-party rights;
- the content creates a security risk;
- removal is required by law or a competent authority;
- removal is required to comply with applicable Discord rules;
- the content materially interferes with operation of the Service.
Where required by applicable law, affected users will receive information about relevant restrictions and available remedies.
Where technically and legally appropriate, automated systems may assist in detecting abuse, spam, malicious activity or other prohibited behavior. Significant enforcement decisions may be reviewed manually where required by law or where appropriate in the circumstances.
Users may contact us using the details in Section 25 if they believe a restriction was made incorrectly.
12. Intellectual Property
Zelia, including its software, source code, branding, graphics, design, documentation and original content, is protected by applicable intellectual property laws.
Except where expressly permitted, these Terms do not grant you ownership of Zelia or any intellectual property belonging to us or our licensors.
You receive only the limited right to use Zelia in accordance with these Terms.
Discord, the Discord logo and related trademarks belong to Discord or their respective rights holders.
Other third-party trademarks and content remain the property of their respective owners.
13. Data Protection and Privacy
Use of Zelia may involve the processing of personal data.
The details of such processing are explained in Zelia's separate Privacy Policy, available at:

Depending on the features used, data processed by Zelia may include information such as:
- Discord user IDs;
- server IDs;
- channel IDs;
- role IDs;
- message or interaction identifiers;
- command information;
- ticket information;
- moderation-related information;
- configuration information;
- timestamps;
- technical and security information;
- information voluntarily submitted through Zelia.
The actual categories of processed information depend on the features used.
Personal data will only be processed where there is an appropriate legal basis under applicable data-protection law.
Use of Zelia does not constitute consent to unrelated or optional processing where separate consent is legally required.
Users retain all rights granted to them under applicable data-protection law.
The exercise of a statutory data-protection right will not result in a contractual penalty.
If particular data is technically necessary to provide a requested feature, exercising a deletion, objection or withdrawal right may make continued provision of that feature impossible. Any resulting consequences will be handled in accordance with applicable law.
14. Security
We take reasonable technical and organizational measures designed to protect the Service and information processed through it.
However, no internet-based service can guarantee absolute security.
Users must take reasonable measures to protect their own Discord accounts, servers, permissions and credentials.
You must notify us promptly if you become aware of:
- a security vulnerability affecting Zelia;
- unauthorized access involving Zelia;
- leaked credentials or authentication information relating to Zelia;
- abuse of Zelia that creates a significant security risk.
Security vulnerabilities must not be exploited beyond what is reasonably necessary to identify and responsibly report them.
15. Availability and Maintenance
We aim to provide Zelia reliably but do not promise uninterrupted or error-free availability.
Temporary interruptions may occur due to:
- maintenance;
- updates;
- security measures;
- technical failures;
- hosting failures;
- Discord outages;
- changes to Discord's API;
- third-party service failures;
- circumstances outside our reasonable control.
Where reasonably possible, planned maintenance that significantly affects the Service may be announced in advance.
Nothing in this Section excludes or limits mandatory statutory rights relating to the availability, conformity or provision of digital services.
16. Updates and Changes to Zelia
Zelia may be updated or modified for legitimate reasons, including:
- improving functionality;
- introducing new features;
- improving performance;
- maintaining compatibility with Discord;
- adapting to changes in Discord's API;
- fixing bugs;
- improving security;
- preventing abuse;
- complying with legal obligations;
- complying with Discord requirements;
- replacing outdated technical components.
Where applicable consumer law requires notice of a change, the required information will be provided in accordance with that law.
Where German statutory rules governing digital products apply, mandatory consumer rights concerning updates and modifications remain unaffected.
If a modification materially and negatively affects a consumer's access to or use of a continuously supplied digital service, any statutory rights to prior information or termination remain unaffected.
17. Suspension and Termination
You may stop using Zelia at any time.
Server administrators may remove Zelia from their server subject to Discord's technical functionality.
We may temporarily restrict or suspend access to Zelia where reasonably necessary because of:
- a serious or repeated violation of these Terms;
- unlawful use;
- abuse of the Service;
- security risks;
- fraudulent activity;
- attempts to circumvent restrictions;
- requirements imposed by Discord;
- a legal obligation;
- an order from a competent authority;
- technical necessity.
Where appropriate, we will consider the nature, seriousness, frequency and consequences of a violation before restricting access.
Where the circumstances reasonably allow it, users may receive notice or an opportunity to remedy a violation before permanent action is taken.
Immediate action may be taken where reasonably necessary to prevent fraud, unlawful activity, security incidents, harm to users or significant disruption of the Service.
Mandatory statutory termination rights remain unaffected.
18. Paid Features
Zelia may offer optional paid or premium features.
Before a paid contract is concluded, users will be informed of the applicable:
- price;
- billing period;
- essential features;
- payment method;
- renewal conditions, if any;
- minimum contract duration, if any;
- termination conditions;
- other legally required information.
Where purchases are processed through Discord or another payment provider, additional terms of that provider may apply.
Nothing in these Terms limits statutory consumer rights.
In particular, where consumers have a statutory right of withdrawal, cancellation, refund, price reduction, cure or contract termination, those rights remain unaffected.
Any legally required information concerning a consumer's right of withdrawal will be provided separately before the relevant contract is concluded.
Paid subscriptions will not automatically renew unless automatic renewal has been clearly disclosed and validly agreed.
19. Statutory Rights for Digital Services
If you are a consumer and mandatory laws concerning digital products or digital services apply to your use of Zelia, those rights remain fully unaffected by these Terms.
This may include statutory rights relating to:
- provision of the digital service;
- conformity of the digital service;
- functionality;
- compatibility;
- security;
- required updates;
- cure of defects;
- price reduction;
- termination;
- reimbursement;
- changes to continuously provided digital services.
Nothing in these Terms is intended to waive a consumer right that cannot legally be waived.
20. Liability
We are liable without limitation:
- for damage caused intentionally or through gross negligence;
- for damage resulting from injury to life, body or health caused intentionally or negligently;
- where liability is mandatory under the German Product Liability Act or another mandatory statutory liability provision;
- where we have expressly provided a guarantee to the extent covered by that guarantee;
- in cases of fraudulent concealment where the applicable legal requirements are met.
In cases of ordinary negligence involving the breach of an essential contractual obligation, liability is limited to the damage that was foreseeable and typical for this type of contract at the time the contract was concluded.
An essential contractual obligation is an obligation whose performance is necessary for the proper execution of the contract and on whose performance the other party may ordinarily rely.
For ordinary negligence outside the circumstances described above, liability is excluded to the extent legally permitted.
These limitations also apply in favor of our employees, representatives, agents and persons engaged by us to perform contractual obligations.
Mandatory statutory consumer rights remain unaffected.
21. Third-Party Services
Zelia depends in part on services operated by third parties, particularly Discord.
Third-party services may experience outages, technical problems, policy changes or API changes that we do not control.
We are not responsible for independent actions taken solely by third-party providers where applicable law does not attribute responsibility for those actions to us.
This does not limit liability where we are legally responsible for the relevant circumstances.
Links or integrations involving third parties do not constitute an endorsement of those third parties unless expressly stated.
22. Changes to these Terms
We may amend these Terms where there is a legitimate reason to do so, including:
- changes in applicable law;
- changes in regulatory requirements;
- changes required by Discord;
- security developments;
- material changes to Zelia;
- clarification of existing provisions;
- introduction of new features;
- prevention of misuse.
Changes will be written clearly and made publicly accessible.
Users will be informed of significant changes within a reasonable period where required by applicable law.
A change that materially alters an existing consumer contract to the user's disadvantage will not automatically become binding merely because the user continues using Zelia where applicable law requires separate agreement.
Where consent to amended contractual terms is legally required, we will request that consent.
If a proposed change cannot validly become part of an existing contract, the previous contractual terms remain applicable to that contract unless the contract is otherwise lawfully terminated.
23. Governing Law
These Terms are governed by the laws of the Federal Republic of Germany, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG), where its exclusion is legally permissible.
If you are a consumer, this choice of law does not deprive you of mandatory consumer protection granted by the law of the country in which you have your habitual residence where such protection applies under applicable conflict-of-law rules.
24. Jurisdiction
For consumers, the legally applicable rules concerning jurisdiction apply.
No provision in these Terms requires a consumer to bring proceedings exclusively before a court at our place of business where such an agreement would be prohibited by applicable law.
If the user is a merchant, a legal entity under public law or a special fund under public law, the courts at our registered place of business shall have jurisdiction to the extent such a jurisdiction agreement is legally permitted.
25. Consumer Dispute Resolution
Unless we are legally required to participate or have expressly agreed otherwise, we are neither willing nor obliged to participate in dispute settlement proceedings before a consumer arbitration board.
This statement does not restrict any statutory right of a consumer to bring a claim before a competent court.

If the same email address is used for both purposes, a single contact address may be provided.
Where applicable law requires a specific contact point, this contact information may also serve as that point of contact provided that all applicable legal requirements are met and communication is not restricted exclusively to automated systems.
27. Severability
If one or more provisions of these Terms are invalid, unenforceable or do not become part of the contract, the remaining provisions remain unaffected where permitted by applicable law.
The applicable statutory provisions shall apply in place of any invalid or unenforceable provision.
28. No Waiver
If we do not immediately enforce a right under these Terms, this does not mean that we permanently waive that right.
Any mandatory rights of users remain unaffected.
29. Entire Agreement
These Terms, together with any additional terms validly incorporated for a specific feature or service, govern the contractual relationship concerning use of Zelia.
Individual agreements expressly made between the parties take precedence over these Terms where required by applicable law.
30. Final Provision
Nothing in these Terms is intended to exclude, restrict or circumvent rights that cannot legally be excluded or restricted.
Where mandatory law conflicts with a provision of these Terms, the mandatory law takes precedence.
